The government is considering bringing an impeachment motion against Justice Yashwant Varma during the upcoming Winter Session of Parliament, sources said.
According to sources, the government is seeking legal opinion on the way forward, particularly as Justice Varma’s resignation has not yet been formally notified as accepted.
The development comes after a three-member inquiry committee constituted to examine the allegations against Justice Varma reportedly found all three charges levelled against him to be established. Sources said the government is examining the legal and constitutional options available to proceed with the matter, including the possibility of moving an impeachment motion in Parliament during the Winter Session.
Probe Report On Justice Varma Presented In Parliament
The report of an inquiry committee investigating allegations against Justice Yashwant Varma, against whom removal proceedings were initiated following the alleged discovery of unaccounted cash from his official residence, was tabled in both Houses of Parliament on Wednesday.
The secretaries general of the Rajya Sabha and the Lok Sabha laid the report in both their Houses respectively.
The report is in two volumes along with oral and documentary evidence recorded during the course of the investigation.
The three-member probe panel had submitted its findings to Lok Sabha Speaker Om Birla in May.
Justice Varma Found Guilty
The Lok Sabha inquiry panel probing allegations against former Delhi High Court judge Justice Yashwant Varma has concluded that all three charges against him stand proved.
In its report, the three-member committee concluded that Justice Varma failed to provide a satisfactory explanation regarding the presence, source or ownership of the cash. Under Article I, the committee held that the charge regarding the presence of unexplained Rs 500 currency notes in a storeroom inside the judge’s residence was proved.
Under Article II, the committee concluded that material evidence was not properly secured or preserved. Under Article III, the committee found Justice Varma’s explanations, including his written response dated March 22, 2025, to be unsatisfactory.
Cash At Judge’s House
A fire broke out in the official residence of Justice Varma on the night of March 14, 2025. Firefighters called to put out the blaze allegedly discovered massive amounts of burnt currency in a storeroom.
Justice Varma has since resigned, and removal proceedings against him have virtually become infructuous. His resignation, however, has not yet been notified by the law ministry.
