A widow has approached the Delhi High Court seeking permission to hand over custody of her 13-year-old adopted son to CARA (Central Adoption Resource Authority) or the Child Welfare Committee (CWC), alleging intellectual disability and hypersexual behaviour and citing fears for her and her family’s safety.
Justice Swarana Kanta Sharma has sought a response from CARA and other respondents on the plea and listed the matter for hearing on September 30.
According to the petition, the petitioner and her husband had adopted a six-year-old boy in 2018 from Assam, but after some time, the boy allegedly started behaving aggressively.
The petition highlights that while at school, the boy allegedly attempted to forcibly kiss a 6-8-year-old girl and tried to take her into a bathroom, following which he was expelled from the school.
Following the death of her husband and the incident at the school, the petitioner moved with her family from Noida to Aligarh and started residing with her elderly mother.
The petition further states that the boy was expelled from several schools due to his alleged misconduct with female students. It also alleges that he started stealing and running away from home. The petitioner subsequently got the boy medically examined, following which he was found to have an intellectual disability and hypersexual behaviour, according to the plea.
The petitioner submitted that as the boy grew older, he became increasingly aggressive and exhibited more pronounced hypersexual behaviour, resulting in constant fear for the safety of herself, her sister and her mother, with whom she resides. She also alleged that the boy becomes violent when he is not given money or is unable to steal money or valuables belonging to the petitioner.
The petitioner has therefore prayed for the child to be handed over to any government or private institution and provided appropriate medical assistance. She has stated that she is willing to bear the expenses to the best of her financial ability.
