Families of four policemen, including an Assistant Commissioner of Police (ACP)injured during the CJP protest march to Parliament, have moved the SC seeking fixing of accountability “on the persons responsible for instigating, abetting and inflicting violence on law enforcement personnel”
They also sought appropriate directions to the Centre to frame guidelines for protecting women and men in uniform while on duty from being assaulted.
The intervention application in the proceedings where two petitions have been filed seeking action against Delhi police and RAF personnel for lathicharge and tear gas against a student and a probe by an SIT appointed by the SC and have been listed for hearing tomorrow has been filed through SC Advocate On Record Venkata Raghuvamsy D.
Senior Advocate Sridhar Potaraju, who mentioned the application before CJI Surya Kant-led Bench today, will be arguing it.
The applicants are families of ACP Kailash Singh Bisht, ASI Sandeep, Constable Dheeraj and ASI Hamendar Rathi.
According to the petition, they “sustained severe, life-threatening injuries during the violent clashes that occurred in New Delhi”. They seek to be impleaded as necessary and proper parties to place critical facts regarding the assault on public servants before this Court.
“The law enforcement personnel deployed from Delhi Police and Central Forces were attacked with glass bottles, stones, sharpened floor tiles and other material on 20th, 24th and 25th July 2026 near Jantar Mantar and other areas in New Delhi.” says the application.
It is submitted that the freedom of speech and expression guaranteed under Article 19 of the Constitution of India is subject to reasonable restrictions. This constitutional guarantee is not an absolute license to inflict hurt, physical injury, or abuse upon fellow citizens or government servants discharging their statutory duties. Much less when the law enforcement agency personnel seek to prevent large scale damage to public and private properties, it says
PRAYER
1) Declare that all persons, including Police and other Law enforcement personnel deployed for maintenance of law and order and security, are equally entitled to the protection of law under Article 14 and Article 21, even when they are on duty.
2) Issue necessary directions to ensure accountability is fixed on the persons responsible for instigating, abetting and inflicting violence on law enforcement personnel.
3) Issue appropriate directions to UOI to frame guidelines for protecting women and men in uniform while in duty from being assaulted.
